Calls for Convicted Murderer to be Removed as Executor to Victim's Estate

A petition has been launched calling for a change in the law in Scotland to prevent a man found guilty of murdering his mother from being able to act as executor to her estate, reports the Daily Mail.

Ross Taggart received a life sentence in 2015 after he was found guilty of killing his mother, Carol, at their home in Dunfermline and then hiding her body under a caravan at a caravan park near Kinghorn, in Fife.

Despite his conviction, he remains executor of his mother’s estate. His sister, Lorraine Bristow, claims he is using this position to block any attempts by her to enter her mother’s house to recover photographs and other items of sentimental value. She has been dealing with his lawyers for the past three years without any success and says she is unable to find any sort of closure while the situation remains as it is.

Together with her husband, Mrs Bristow has launched a petition seeking support for a change to the law to prevent convicted killers from being able to act as executor for the estate of their victims. The petition has apparently already attracted thousands of signatures.

A spokesperson for the Scottish Government has said that the concerns raised in the petition have been noted, reports the Daily Mail. The spokesperson also pointed out that it is sometimes possible to raise a legal action in the Court of Session to have an executor removed.

Reviews

"Handling a family bereavement is never an easy matter, especially when you have no understanding of probate/estates - a situation I unfortunately found myself in last July. I turned to Wilson & Fish Solicitors after seeing a recommendation online and from start to finish I have been treated with nothing but professionalism. Donna from Wilson & Fish helped me to understand the full process, explained the fee breakdown (an initial concern) and kept me updated all along the way meeting with me personally when required. At every point I felt my late fathers estate was being handled with care and attention and - in turn - this helped me along the road to recovery. I would without a doubt use Wilson & Fish again and fully recommend them. Thank you once again to Donna and the team."
