If a loved one has recently passed away, you will need to find out whether they made a will and where the will is held. Most people have a solicitor hold their will on their behalf to ensure its safety. It is essential to find the will of a loved one at an early stage, as the will lets you know who has been appointed as an executor. However, if your loved one has not passed on any information about which solicitor or firm helped them to make their will, you may be wondering how you can find out to move forward in the executry process.

First steps 

Firstly, you may wish to search your loved one’s home for any clues. They may have a copy of their will or letters from a solicitor. You may also be aware of a solicitor they have used for other matters, such as buying a home or getting a divorce. You may then want to contact any of these solicitors to find out if they hold the will. 

Order a copy of the will from Registrars of Scotland

If the will was registered with Registrars of Scotland, you can order a copy of the will. It is important to note, that although your loved one may have told you they made a will, this may not be the case. Also, the person who has passed away or their solicitor may have failed to register the will, perhaps because it was not complete or for any other reason. 

To obtain a copy from Registrars of Scotland, you will need to provide: 

  • the full name of the person whose will you are looking for
  • the date the will was  recorded in the Register of Deeds

If you do not know the date the will was recorded, Registrars of Scotland can use the other information provided to carry out a search. The search costs £25+VAT. 

Try National Records of Scotland 

National Records of Scotland may be used if you need to find a historic will - generally, a will made before 1993. 

Contact The Scottish Courts and Tribunals Service

If the will was registered with a Court, you may be able to find it through the Scottish Courts and Tribunals Service. However, it is uncommon for a will to be registered with a court. 

Try the Government Website

If you believe the will may be held elsewhere in the UK, you can check the UK government service to search for any record of the will. If you are unable to find the solicitor that holds the will, or gain a copy through one of these methods, you may wish to contact a solicitor for specialist advice.
